Zimmer Inc. won the first federal trial in multidistrict litigation involving its Durom Cup hip implant, as a jury May 12 found a Louisiana woman’s claims time-barred (Brady v. Zimmer Inc., D.N.J., 10-3043, verdict 5/11/15).
The jury in the U.S. District Court for the District of New Jersey found that plaintiff Christine Brady was on notice of a possible claim by Dec. 18, 2008, more than a year before she sued Zimmer and related companies. Therefore, her claims under the Louisiana Product Liability Act were barred by the state’s one-year prescriptive period.
