A Texas trial court should’ve dismissed a wrongful death suit against Bridgestone Americas Tire Operations LLC over a car accident in Mexico because Texas wasn’t a convenient forum for the case, the Texas Supreme Court ruled (In re Bridgestone Ams. Tire Operations, LLC, 2015 BL 117644, Tex., 12-0946, 4/24/15).
The state high court held the Texas resident exception to forum non conveniens didn’t apply in a suit filed by the Texas-based uncle of children whose parents were killed in a rollover accident in Mexico after a tire allegedly failed on the family’s 1996 Ford Explorer.
