Whole Foods Faces Trial Over Sign Part That Fell on N.Y. Woman

Whole Foods Market Group can be held liable for an incident in which part of a letter on a neon sign fell allegedly fell from the company’s Union Square grocery store and hit an exiting patron on the head, a New York appeals court affirmed.

Some breakage seven years earlier created fact issues for trial on Zoljargal Nyambuu’s negligence claim, the New York Supreme Court, Appellate Division, said Tuesday.

The signmaker and installer were properly dismissed from the suit, the court said.
