Weyerhaeuser Co. won dismissal of claims that family members developed mesothelioma from asbestos brought home on employees’ clothing.
The estates of Herbert Spatz and Elvira Kilty failed to show that non-occupational exposure was a substantial contributing factor to their cancer, the Western District of Wisconsin said.
The decision comes ten days after the court ruled that the estates may proceed with allegations that 3M’s respirators failed to protect Spatz and Kilty from asbestos exposure.
Kilty and Spatz worked for Weyerhauser in a factory in Marshfield, Wis., that manufactured fireproof doors containing asbestos cores.
