Wegmans Defeats Misleading Vanilla Ice Cream Marketing Suit

Consumers failed to show that Wegmans Food Markets Inc. tricked them about the source of the flavoring in its vanilla ice cream, a federal court in New York said Tuesday.

Quincy Steele and Jimmy Arriola alleged the grocery chain violated New York and Pennsylvania consumer protection laws by deceiving them into thinking the ice cream was flavored with vanilla beans or vanilla bean extract, even though most of its vanilla flavor comes from some non-vanilla source.

Federal regulations require products called “vanilla” to be flavored exclusively with vanilla extract, vanilla concentrate, or vanilla beans, the plaintiffs said.
