WaterWipes USA Inc. failed to convince a federal judge to dismiss a proposed class action alleging it deceptively advertised its products as containing “Just 2 Ingredients” because it includes an additional preservative.
Though the parties focused on whether the preservative, benzalkonium chloride, must be disclosed under federal regulations, the US District Court for the Northern District of California said Wednesday that advertising the product as only containing water and a drop of fruit juice when it also contains the preservative “can still be misleading.”
