After spending nearly 400 hours renovating his wooden deck by hand, Rudy Cortinas had high hopes an additional 500 or so hours applying Behr’s Premium DeckOver Coating would provide the final touch (Cortinas v. Behr Process Corp., 2017 BL 187975, E.D. Mo., 4:16-CV-1718 (CEJ), 6/5/17).
But instead of bringing “new life” to the 8,000 square-foot handiwork at Cortiinas’ St. Louis home, the wood began cracking and peeling within seven months of the 2013 application, he said.
Now Cortinas wants manufacturer Behr Process Corp. to pay him $25,000 for his troubles, and his suit can proceed although some claims ...
