The maker of an allegedly defective fire extinguisher sold at stores like Walmart escaped most of a proposed class action after a federal trial court dismissed all but three of 19 claims.
The two named plaintiffs didn’t properly plead the “who, what, where, when, and how” for multiple claims based on Walter Kidde Portable Equipment Inc.'s alleged fraudulent concealment or misrepresentations about the effectiveness of the portable fire extinguishers, the US District Court for the Middle District of North Carolina said. They only stated that they relied on interviews and marketing materials, the court said.
