Walmart Wants Huffing Spray Suit Over Girl Scouts’ Deaths Tossed

Walmart Inc. asked the Northern District of California to dismiss a suit by the relatives of two Girl Scouts and a chaperone killed on a Wisconsin highway by a driver high on Ultra Duster, citing a “substantially identical action” filed by others in Wisconsin state court.

The U.S. District Court for the Northern District of California should abstain from hearing the case because filing suit there “was a blatant act of forum-shopping designed to avoid application of the Wisconsin tort reform statutes,” Walmart told the court.
