Walmart Loses Bid to Enforce Unsigned Injury Settlement

Walmart Stores Inc. can’t enforce a confidential slip-and-fall settlement the plaintiff never signed, a federal court in Wisconsin ruled.

Even though counsel for Lawrence Hendrickson orally agreed to an unspecified monetary payment to drop the case, that isn’t enough to constitute a binding settlement agreement, the U.S. District Court for the Eastern District of Wisconsin said.

Hendrickson says he was injured in a 2014 fall in a parking lot of a Walmart store in Manitowoc, Wis. He sued the company for negligence for failure to keep the parking lot in good repair.
