Walgreens Claims in Talc Suit Sends Case Back to State Court

Walgreens’s alleged knowledge of the dangers of talc products on its shelves is enough to send an ovarian cancer suit back to state court, the U.S. District Court for Southern District of Illinois said.

Defendant Johnson & Johnson failed to show that the estate of Elizabeth Driscoll fraudulently named Walgreens as a defendant in an effort to keep the case in state court.

The estate alleges that Walgreens knew or should have known, based on studies going back to the 1960s, that the use of talcum powder-based products in the perineal area significantly increased the risk of ovarian cancer.
