Viking Pump Inc. will have to defend a pipefitter’s asbestos exposure claims in South Carolina.
A Louisiana trial court dismissed the claims without prejudice over the company’s objection.
It wasn’t required to rule on Viking’s motion for summary judgment, which would have resolved the claims had the company won, a Louisiana appeals court said.
James Sizemore, a South Carolina resident, filed suit in 2016 against Viking and other companies in Louisiana state court. After he died in June 2017, his estate was substituted as plaintiff.
