Suzuki Motor Co. isn’t liable for a Mississippi man’s injuries in a road accident because evidence rulings favorable to the company were within the trial court’s discretion, the Fifth Circuit ruled.
The trial court had sufficient reason to reject evidence of a brake system recall notice and emergency-room utterances by the injured man, Bradley Stubblefield, the appeals court said Aug. 28. Its decision to allow evidence that Stubblefield was an aggressive rider wasn’t reversible error, the panel said.
