Venice Beach Mass Attack Crash Suits Can Go to Trial

The City of Los Angeles isn’t entitled to immunity from suit for a Venice Beach Boardwalk crash in which a motorist intentionally mowed down 17 pedestrians, a California appeals court ruled Oct. 17 in an unpublished decision (City of Los Angeles v. Superior Court of L.A. Cty., 2017 BL 371590, Cal. Ct. App., 2d Dist., No. B280429, unpublished 10/17/17).

A California law granting “trail immunity” to municipalities for injuries on recreational byways doesn’t apply because of the extensive commercial development along the iconic boardwalk, the court ruled in two cases.
