Three students who were enrolled in the University of Southern California’s online degree program can sue over ads promoting a US News ranking that they allege was pumped up with incomplete statistics, a California federal court ruled.
USC and education technology company 2U Inc. moved to dismiss the students’ proposed class action, which seeks damages under the state’s Consumer Legal Remedies Act. The US District Court for the Central District of California denied the motion with respect to USC, and dismissed but granted the students leave to amend their complaint against 2U on Wednesday.
