Ulta Defeats Class Status in Suit Alleging It Resold Used Makeup

Ulta Beauty Inc. beat class status in a suit alleging it systematically resold used beauty products as new after a federal court in Illinois said no uniform company policy over used products had been shown.

Also, too many individual issues would arise as to whether particular consumers purchased the used makeup, the U.S. District Court for the Northern District of Illinois said Thursday.

The suit’s filing came after a former employee tweeted that workers were encouraged to touch up and repackage returned merchandise and put it back on the shelf to be sold again.
