Uber Win in California Predatory Pricing Suit Upheld

Uber Technologies Inc. isn’t subject to a California law prohibiting below-cost sales under an exception for certain utilities, a California appeals court said in a blow to taxi companies and medallion holders.

The Unfair Practices Act doesn’t apply to Uber because the California Public Utilities Commission has jurisdiction over it, the California Court of Appeal, First District, said Monday. That’s true even though the commission hasn’t yet set rates for Uber’s products or services, the court said, affirming the lower court.

Three federal court judges in California have come to the same conclusion, the state appeals court said.
