A woman who rented an apartment in a Houston suburb can’t pursue toxic mold claims against her property management company, the U.S. District Court for the Southern District of Texas said.
Plaintiff Virginia Carter failed to present an expert witness to show that mold can cause this type of illness or that she was exposed to a level of mold sufficient to sicken her, the court said.
The court rejected Carter’s argument that an expert is unnecessary when a sequence of events provides a logical, traceable connection between the event and condition.
