Toss Tito’s Vodka Label Suit, Maker Says

The maker of Tito’s Handmade Vodka asked a federal court in Massachusetts to toss a proposed class suit challenging the word “handmade” on the product label, saying the plaintiff’s definition “has no basis in law or common sense” (Emanuello v. Fifth Generation, Inc., D. Mass., 15-11513, motion filed 8/5/15).

No reasonable consumer could share plaintiff Lynica Emanuello’s belief that the vodka is made without industrial equipment, producer Fifth Generation, Inc., told the U.S. District Court for the District of Massachusetts in an Aug. 5 dismissal motion.
