A California woman has voluntarily dropped her claims stemming from Tootsie Roll Industries Inc.'s use of partially hydrogenated oils in candy and lollipops, a filing in a California federal court says.
Tootsie Rolls and Tootsie Pops contained the oil, a type of trans fat, without meeting an exception to Food and Drug Administration regulations, Maxine Beasley alleged. She also contended she suffered physical injury because any quantity of trans fat increases the risk of disease.
Beasley’s claims were dismissed without prejudice, the Monday filing in the U.S. District Court for the Northern District of California said.
