A federal district court went too far in restricting the rights of retired NFL players to use third-party lenders to get advance payouts under the league’s $1 billion concussion settlement, a federal appeals court ruled April 26.
The decision by the U.S. Court of Appeals for the Third Circuit gave lenders another chance to argue the agreements remain viable in the closely-watched case, which involves a novel intersection of arbitration law, district court authority over class settlements, and the rights of brain-injured players to make decisions about funds they receive under settlement.
