The Texas Commission on Environmental Quality won its bid to dismiss a lawsuit brought by the Guadalupe County Groundwater Conservation District which sought to prevent the construction of a landfill, after a Texas appeals court said Wednesday that a lower court lacks jurisdiction to hear the case.
TCEQ oversees municipal solid waste landfill permits, the Texas Court of Appeals, Fourth District said. Post Oak Clean Green Inc. filed an application with TCEQ for a permit to construct and operate a municipal solid waste landfill located within the outcrop area of the Carrizo-Wilcox aquifer recharge zone within the Guadalupe district.
