Teva Says Woman’s IUD Injury Claims Barred

Teva Pharmaceuticals USA, Inc. wants a federal court to throw out a woman’s suit that alleges part of her ParaGard intrauterine device broke and lodged in her uterus during removal.

Federal drug law preempts Stephanie Ideus’s claims that it didn’t adequately warn about the risks of fracture and embedding, Teva told the U.S. District Court for the District of Nebraska Nov. 13.

The IUD is a combination drug and medical device product approved as a drug.

The U.S. Supreme Court is set to consider related drug preemption issues this term in a case involving the osteoporosis drug Fosamax.
