A recent ruling allowing consumers who allegedly “paid for bird food but received bird poison” to proceed with federal conspiracy claims on a nationwide class basis could be one of the first of its kind(In re Morning Song Bird Food Litig., 2017 BL 106769, S.D. Cal., 12-cv-01592, class certified 3/31/17).

Racketeering is among the claims that the U.S. District Court for the Southern District of California approved for class treatment in the suit against The Scotts Miracle-Gro Co., The Scotts Co. and an executive at the companies.
