Suit Over Nail Fungus Product Stays in Federal Court

A proposed consumer class suit against the makers of a nail fungus treatment will stay in federal court, as a federal trial court in California Jan. 4 said the putative class members’ claims exceed the $5 million threshold needed to confer jurisdiction under the Class Action Fairness Act (Minkler v. Kramer Laboratories Inc., C.D. Cal., No. 12-9421).

Brian Minkler sued Kramer Laboratories Inc. and Kramer Consumer Healthcare in September 2012 purportedly on behalf of California residents who bought Fungi-Nail, an anti-fungal product.
