Defendant SoClean Inc. agreed with plaintiffs that federal litigation alleging it deceptively marketed devices for disinfecting sleep apnea breathing machines should be combined into one multidistrict proceeding, but the company disagreed on where that should be, according to a filing with the MDL panel.
Larry Hunter-Blank, William Wheeler, and others filed proposed class actions alleging that SoClean advertised its cleaning products as “safe” and “healthy,” when they generate toxic ozone gas at levels that exceed federal regulations.
The cleaning devices are used to maintain CPAP machines, which treat sleep apnea and other respiratory conditions.
