Smith & Nephew, Inc. and Zimmer Inc. won dismissal of claims that their knee replacement parts were defective.
Barbara Grzanecki failed to allege how the parts were defective in manufacture or design, the U.S. District Court for the Northern District of Illinois said May 30.
Grzanecki’s failure to warn claims must also be dismissed because she didn’t allege that the companies owed her, or her doctors, a duty to warn, the court said.
And she didn’t identity the warnings provided by the companies or how the warnings were inadequate, the court said.
