Sanofi Exits Two Taxotere Test Cases While Two Others Advance

Sanofi-Aventis U.S. LLC and others fended off two test cases alleging they didn’t adequately warn that the breast cancer drug Taxotere caused permanent hair loss, but failed to get two others thrown out.

Deborah Johnson and Tanya Francis had one year under Louisiana law to sue, and they filed too late, the U.S. District Court for the Eastern District of Louisiana said July 9.

Johnson and Francis both attributed their hair loss to chemotherapy, which should have prompted them to investigate, the court said. Yet both waited more than a year to sue, the court said.
