Samsung Can’t Curb Exploding Cell Phone Class

Samsung will have to defend in court class action claims that its cell phones pose a risk of exploding.

Though the claims of several plaintiffs are subject to arbitration clauses and require dismissal, the claims of nine named plaintiffs may go forward, the U.S. District Court for the Northern District of California ruled.

Examining the arbitration notice for each model of phone, the court found many of the notices to be insufficient to compel arbitration, allowing those cases to go forward in court.

Judge Beth Labson Freeman issued the ruling.
