Hoffmann-LaRoche Inc. won reversal of a $25 million verdict in an Accutane inflammatory bowel disease case, as a New Jersey appeals court tossed the award and ordered what would be a third trial for an Alabama man (McCarrell v. Hoffmann-LaRoche, Inc., N.J. Super. Ct. App. Div., No. A-4481-12T1, unpublished 5/2/17).
The trial court improperly limited the number of witnesses the drugmaker could call to dispute plaintiff Andrew McCarrell’s contention that the acne drug caused his disease, the New Jersey Superior Court, Appellate Division, said May 2 in an unpublished decision.
