Though the plaintiff alleged the label was deceptive because the cold and cough medicines didn’t contain honey as an ingredient, the US District Court for the Eastern District of New York on Jan. 31 said the label only guarantees the flavor will include honey.
“The distinction is significant—stating that a product is honey-flavored is not tantamount to representing that a product contains honey,” Judge Pamela K. Chen said, dismissing the proposed consumer class action.
