A real estate agent who alleged that an online referral company misleads home buyers and sellers about its services can’t sue under the federal false advertising law.
Coty Lewis’ suit over a referral fee paid to Acuity Real Estate Services alleges consumer injuries, which aren’t covered by the Lanham Act, the US Court of Appeals for the Sixth Circuit affirmed Tuesday.
Acuity operates a website that connects people looking to buy or sell homes with a local real estate agent in their area. Services are free to buyers and sellers but agents must pay a fee.
