Rachael Ray’s pet food company Ainsworth Pet Nutrition LLC convinced a federal court to dismiss a suit alleging “natural” dog food was deceptively marketed because it contained residue of the weedkiller glyphosate.
Markeith Parks’s claims under New York consumer protection law and his breach of express warranty claim failed because he didn’t specify the amount of glyphosate in the products or whether that amount is harmful, the U.S. District Court for the Southern District of New York said.
