Purell Maker Gojo Keeps Win in Hand Sanitizer Deception Suit

Purell consumers wouldn’t reasonably think that the label statement “kills more than 99.99% of germs” means the popular hand sanitizer kills that percentage of all germs in existence or known to science, a federal appeals court affirmed.

Kristina Robles alleged that the statement would make purchasers believe Purell has been scientifically proven to kill all (or all known) germs, especially those that may cause illness.

But the front label includes an asterisk directing consumers to the back, which says Purell “Kills 99.99% of most common germs that may cause illness,” the US Court of Appeals for the Ninth Circuit said ...
