Proof of Post-1979 Asbestos Exposures Saves Claims Against One of 11 Defendants

Only one defendant remains in a suit for the wrongful death of a man exposed to asbestos over the course of several jobs after the U.S. District Court for the Southern District of Alabama Aug. 30 granted summary judgment to 10 of 11 asbestos defendants (Morgan v. Bill Vann Co., S.D. Ala., No. 11-535).

Alabama’s discovery rule for asbestos claims applies only to post-1979 exposures, the court said. The court found that the plaintiff provided sufficient evidence of exposure to products made by the remaining defendant after the statutory deadline.
