Product Liability Claims Survive in Bayer Herbicide Lawsuit (1)

Bayer Corp. must face product liability claims from a honey bee farm alleging its dicamba herbicide products drifted into their lands and led to a reduction in honey and a loss of bees, a federal judge in Missouri said.

Dicamba, a herbicide used for controlling weeds in crops like corn and soybeans tends to vaporize when temperatures get too high, meaning that the herbicide travels and spreads to nearby fields and farms that are often not genetically engineered to tolerate the herbicide, the plaintiffs said.
