Post Defeats Honey Bunches of Oats Misleading Label Suit

Post Consumer Brands LLC beat a proposed class suit alleging it tricked consumers into thinking Honey Bunches of Oats was primarily sweetened with honey.

Anita S. Lima and Susan Wrublewski alleged Post breached express warranties, violated state consumer protection laws, and unjustly enriched itself by creating that impression through the name and graphics. This was deceptive because the cereal is primarily sweetened with sugar, brown sugar, and corn syrup, they said.

But the label isn’t deceptive because honey is a flavor as well as a sweetener, the District of Massachusetts said Aug. 13.
