Ply Gem Gets Early Exit From Vinyl Siding Suit

Ply Gem Industries Inc. won’t have to face a proposed class suit alleging its vinyl siding “degraded” when exposed to sunlight and other normal environmental conditions.

The homeowners in New York, Pennsylvania, and Delaware didn’t show enough of a connection between Ply Gem and New York, where they sued, the U.S. District Court for the Northern District of New York said Oct. 22.

The ruling is another example of the breadth of a new U.S. Supreme Court jurisdiction decision. The decision, which limits where state suits can be filed, also is being extended to class actions brought in federal court. ...
