A Michigan fitness enthusiast may proceed with claims that PhD Fitness LLC misrepresented is dietary supplements as delivering scientifically supported doses of key ingredients, a federal court ruled in a class suit Jan. 31.
Jeff Johnston gave plenty of detail in his complaint about the alleged negligent misrepresentation, the U.S. District Court for the Eastern District of Michigan said.
And he adequately alleged he’d relied on the Pre-JYM and Post-JYM products’ labels about their research-backed dosing, the court said.
A disclaimer that the product was “not intended to diagnose, treat, cure, or prevent any disease” didn’t undermine Johnston’s alleged reliance ...
