Pet Supplement Class Certification Upheld in False Ad Lawsuit

Nutramax Laboratories Inc. failed to convince a federal appeals court that class certification was improperly granted in a consumer-led action accusing the company of deceptively marketing Cosequin supplements as supporting healthy joints in dogs.

The US Court of Appeals for the Ninth Circuit on Monday rejected Nutramax’s argument that class certification was inappropriate because the consumers’ expert hadn’t yet applied his damage model.
