PepsiCo, Inc. will modify the labeling of its Naked fruit and vegetable juices and smoothies, resolving consumer allegations the drinks were deceptively marketed to mask a high sugar content (Lipkind v. PepsiCo Inc., E.D.N.Y., settlement 2/21/17).
The agreement, announced Feb. 21, settles a proposed class suit filed in October 2016 by the Center for Science in the Public Interest.
Plaintiffs alleged PepsiCo names each Naked beverage after a food or ingredient perceived by consumers to be highly nutritious, like “Kale Blazer,” and fills the labels with photographs of these ingredients.
