Paint Makers Get Boost in California Lead Paint Appeal

The U.S. Supreme Court should overturn a finding last year that three paint makers are responsible for creating a decades-long lead paint nuisance in California, a conservative free-market group says in a new filing.

The Washington Legal Foundation amplifies arguments made by ConAgra Grocery Products Co. and NL Industries Inc. in a Supreme Court petition filed in July.

The paint makers contend the 2017 California ruling against them, and the Sherwin-Williams Co., imposes massive retroactive liability against the companies without proof they were responsible for the presence of lead paint in thousands of California homes.
