Procter & Gamble Co. agreed to pay up to $30 million and make ad changes to settle a consumer class suit alleging it deceptively touted its Align probiotic supplement as “clinically proven” to aid digestion (Rikos v. Procter & Gamble Co., S.D. Ohio, No. 11-00226, motion for preliminary approval filed 9/29/17).
The settlement came after seven years of litigation and shortly before trial was to start, according to a motion for preliminary approval filed Sept. 29 in the U.S. District Court for the Southern District of Ohio.
