Oyster Producer Recovers Losses Tied to Food Poisoning Death

Breton Sound Oyster Co. will be able to collect from its insurer a $900,00 jury award tied to a falling out with a retailer over a man’s food poisoning death.

The policy Stiel Insurance Co. brokered excluded bacteria-related accidents but the oyster company proved it asked for, and believed it got, full coverage for product liability claims arising out of injuries or deaths, a Louisiana appeals court said Dec. 12.
