Owens Corning Avoids Defective Shingle Class Action

Owens Corning is off the hook for a defective shingle class action, the U.S. Court of Appeals for the Third Circuit affirmed March 19.

Class treatment is inappropriate because the homeowners can’t show the defect is common to all shingles made during the class period, Judge Thomas M. Hardiman wrote for the appeals court.

Owens Corning made at least 23 kinds of Oakridge shingles at 13 plants around the country using more than 500 design specifications, the court found.

Homeowners from four states sued Owens Corning alleging the Oakridge shingles on their roofs were defective and had to be replaced. ...
