Ocean Spray Can’t Pour Out Labeling Suit

Ocean Spray Cranberries Inc. can’t duck a proposed class suit alleging it deceptively markets drinks as having no artificial flavors when they contain synthetic flavoring agents for tartness.

Crystal Hilsley may have a jury decide her claims alleging Ocean Spray included fumaric acid and d-l malic acid as ingredients in various products, the U.S. District Court for the Southern District of California said.

The court’s ruling that there is a factual dispute over whether malic acid and fumaric acid function as flavors in the challenged Ocean Spray drinks could help plaintiffs in other suits over these ingredients.
