Navy Technician’s Estate Gets Asbestos Suit Revived on Appeal

Triple A Machine Shop Inc. faces reinstated claims by the widow of a U.S. Navy shipworker allegedly exposed to asbestos while working at the company’s ship-repair facility in San Francisco.

Enough circumstantial evidence exists that Michael Harris was exposed to asbestos while doing repair work on a Navy ship to survive summary judgment, the California Court of Appeals ruled June 26.

The trial court erred when it dismissed the claims finding “no evidence that Harris was present when asbestos fibers were released into the air,” the appeals court said.
