Natrol LLC won’t get a quick exit from a proposed class suit alleging its Cognium memory booster doesn’t work.
Missouri resident Christine Vitello adequately stated consumer fraud claims on behalf of a nationwide class and a Missouri subclass, the U.S. District Court for the Eastern District of Missouri said.
Consumer suits against dietary supplement makers are on the rise, especially over products purportedly promoting memory and youth. The Food and Drug Administration doesn’t have authority to review supplements for safety and effectiveness before they are marketed.
