Mouse Repeller Class Deal Gets Early Nod on Second Try

A proposed class deal between BHH LLC and consumers who allege they were duped into buying ineffective ultrasonic mouse repellers got a preliminary green light from the Southern District of New York, following an initial rejection because of problems with the attorneys’ fees.

Last month, the U.S. District Court for the Southern District of New York said a “quick pay” feature for the plaintiffs’ lawyers, and a provision that an arbitrator would decide their fees, doomed the deal.
