Mondelez Wins Dismissal of Lorna Doone Shortbread False-Ad Suit

Mondelez Global LLC is free of a proposed class suit over Lorna Doone cookie labels, after a federal judge said “shortbread” in the name doesn’t imply “butter” in the ingredients.

Zilphia Howze alleged that because the only fats in the cookies are canola and palm oils, Lorna Doone’s packaging is deceptive because consumers expect butter.

But the packaging doesn’t list butter as an ingredient and nothing in the word “shortbread” would lead a reasonable consumer to believe that the cookies must contain butter, the US District Court for the Western District of New York said in an order entered Jan. ...
